How can one protect themselves?

From what prospective? - Do you want to sub let yours or sub let from someone else?

I'm no expert (other than it's generaly not allowed!) but we may be able to get some advice.

Anyone?

Thanks, I have been offered to sublet someone else's apartment.

We are drawing up a sublease agreement, however, I wonder what weight this holds legally should there been any issues.

How can i protect myself. As I will not be on the lease as such?

I haven't seen the lease for the apartment however, will be requesting this.

any suggestions?

ok subletting is illegal without the permission of the owner. this is a copy from the abu dhabi law, i cant find where i put the dubai one, but they are usually the same but just written slightly differently, who this helps.
Chapter IV
Assignment of the Lease and Sub-Letting

Article (17)


- Lessee may not assign the lease or sub-let the Leased Premises in full or in part except with the written consent of the lessor.

- Any permission granted after the act, whether express or implied, shall be treated as a prior written consent of the act.

- The Lessor may grant the Lessee in the lease contract the right to assign or sub-let the Leased Premises in whole or in part. In the case of sub-letting, the terms of the contract between the Lessee and the sub-lessee may differ from those of the original lease contract provided that it does not contradict with them and does not violate the provisions of the second paragraph of Article (16) of this law and provided that the term of the sub-lease contract does not exceed the specified term of the original contract.

- If the Lessee sub-let the Leased Premises, the sub-lease contract shall govern the relationship between the Lessee and the sub-Lessee. The sub-lease contract shall not affect the rights and obligations of the Lessee towards the Lessor pursuant to the original lease contract, unless the parties agrees otherwise.

The first thing to say is that subletting is not allowed without the consent of the landlord. The Ejari is issued to the tenant, but if this tenant goes on to sublet with or without the consent of the landlord, the person who sublets is not covered by the law as the Ejari is not in his/her name, therefore he/she is not protected.
