Buying Property in Morocco - US Citizen
I have a question about property / owner tittle in Morocco. I am a US citizen and my husband is Moroccan. Last year we decided t invest in a small apartment in Marrakech, Morocco. We had conflicting schedules and we decided that my husband would go and handle the business and that I would provide him with all the necessary paper work so he could do business there on my behalf.
This has been quite a nightmare to say the least. We went to the Moroccan Consulate here in the US and paid for a Power of Attorney. They advised us that this is all we needed for him to conduct business in Morocco on my behalf (so my name would appear on the title as owner as well.
We paid for the POA, I provided him with an employment letter, pay stubs for the last six months, our tax return for the previous year, by birth certificate translated into the local language. When he arrived in Morocco and went to the bank he found that he could not purchase the apartment under my name because I was not there to sign off on the loan in person.
This was disappointing especially since we had been advised by the Moroccan consulate that this would not be a problem. We bought the apartment anyway – and one of the representatives at the bank told him when he got to the states he should write a letter explaining the circumstances for them to review it. We did just that and again were told that they could not do it because I was not there to sign off on the loan.
To me at least this is quite alarming. It is important to me that my name is on the title of this apartment and any other property as 50% owner since 50% of all funds invested come from my pocket.
At this point I am not exactly sure what our options are and if I understand the law correctly as of right now if something were to happen to my husband I would own 1/8 of this property and the rest would go to his family. We were told that when we both go to morocco – my husband can create a will like document in which he will donate half of this property to me. Another option is that when the property is paid in full, he can put my name on the papers.
Has anyone experienced something like this? Any advise will be greatly appreciated.
