immigration through marriage to Mexican

Post Posted: Tue Jan 13, 2015 11:21 pm

I am a US citizen and recently married a Mexican man (he's residing in Mexico and I live in the U.S.). He wants to bring me and my son (from a previous relationship) to reside with him in Mexico. Does he begin the immigration process for us through the INM in Mexico? Or do I need to apply through the Consulate in NYC?? Can't find a clear answer to this...

Thanks.

Elizabeth

Hello Elizabeth, Im Jesus Farrera, im a lawyer Specialist in migration laws in mexico,

For these procedure, are two ways.

1.- You have to request the the Visa for Family Unit, This visa had to be request to the INM in mexico, For your Husband, IF HE is in MEXICO!, and if HE IS in USA, he can request to the consulate in NY with you and your SON, Your son has to be Under Age for have the Visa.

The Visa granted for this procedure, is a Temporary residence in Mexico, For two years, after the two years you can upgrade for a Permanent.

And the other way

2.- For being a us citizen, You can enter a mexico for 30 to 180 days, Only have to fill a FMM, this is a Format that you have to fill to enter mexico, You can ask for it, in the border, or the airline gives to you when fly to mexico, When you are in mexico, You can process your temporary residence here in mexico, in the Neares office of INM, For being married with a Mexican.

These are the 2 ways to make the process, For the two you have to make the paperwork, and complete the requirements that are requested. If you want help for make the process, can contact me. I left my Fan Page of Facebook, in my sign.

Regards. Jesus Farrera
