Hi all

I have now moved to Nerja with my wife and just wanted to know if my business that I run from Spain (it is a uk based business) still comes under UK VAT?

Is it trading in the UK, or is it trading in Spain?

Is it REGISTERED in Spain or UK? You can work in either country, but where are you registered. Unless you have advised the UK tax office that you are no longer trading in the UK, you will still be reuired to submit tax returns for it.

Well .... strange as this may seem, in theory you have to remain VAT registered if you are over the threshold in the UK, but your asset and income from the business will probably be taxed in Spain! You may be taxed in the UK at UK levels, but the "balance" of tax to take it to Spanish levels would be taken in Spain

However, I'm guessing there is all kinds of scope for creative accounting in your position. I'm sure you will have a good accountant in the UK, but how about getting them in touch with a good gestoria in Spain!

I'm sure there's a worthwhile way of doing this (living in Spain, but running a UK business) as we've discovered several clients or enquires from Brits in Spain running a business in the UK.

Some guy UK business was an ebay store selling to the UK, but shipping from the US but living in Spain. (I assume he just got stuff sent direct to clients from the USA)

He seemed (from his feedback) do be doing a roaring business, so there must be some way of getting the tax/vat situation to suit yourself.
